1. Acceptance of Terms

Welcome to OverSpend.me. By accessing or using our subscription tracking service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use our Service.

You must be at least 18 years old to use OverSpend.me. By using our Service, you represent and warrant that you meet this age requirement.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email with 30 days' advance notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

2. Service Description

OverSpend.me is a web-based subscription tracking application that helps you manage recurring payments and monitor your expenses. Our Service includes:

Subscription Management: Track recurring payments with calendar and list views showing upcoming charges.
Multi-Currency Support: Manage subscriptions in 40+ currencies with automatic conversion to your preferred currency.
Analytics Dashboard: View spending trends, category breakdowns, and month-over-month comparisons.
Notifications: Receive email reminders 2 days before charges, optional WhatsApp notifications, and monthly spending summaries.
Free Plan: Track up to 7 active subscriptions with full access to all features.
Pro Plan: Unlimited subscriptions with enhanced features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to users.

3. Account Registration & Authentication

To use OverSpend.me, you must create an account by authenticating through one of our supported OAuth providers (Google or Facebook) via AWS Cognito.

Required Information

Email address: Obtained from your OAuth provider and used for authentication and notifications.
Name: Obtained from your OAuth provider (optional).

Optional Information

Timezone: For accurate notification timing.
Phone number: Only if you opt in to WhatsApp notifications.
Main currency: Your preferred currency for analytics.

Account Security

You are responsible for maintaining the security of your OAuth provider account (Google/Facebook). We implement industry-standard AES-256-GCM encryption to protect your personal data, but cannot control the security of third-party authentication providers.

You agree to notify us immediately at security@overspend.me if you suspect any unauthorized access to your account.

4. Subscription Plans and Billing

Track up to 7 active subscriptions
Full access to all features (analytics, notifications, multi-currency)
No credit card required
No time limit

Pro Plan

Unlimited active subscriptions
All Free plan features included
Monthly billing via Stripe
Immediate upgrade upon successful payment

Billing Terms

Pro plan subscriptions are billed monthly in advance. By upgrading to Pro, you authorize OverSpend.me to charge your payment method on a recurring basis. Billing is handled securely through Stripe.

Cancellation Policy

You may cancel your Pro subscription at any time through the Billing Portal. Cancellations take effect at the end of your current billing period. No refunds are provided for partial months.

Refund Policy

We do not offer refunds for Pro subscriptions except as required by law. If you believe you are entitled to a refund due to a billing error, contact support@overspend.me within 30 days of the charge.

Price Changes

We reserve the right to change Pro plan pricing with 30 days' advance notice via email. Price changes will not affect your current billing period.

5. User Content and Data Ownership

Your Data

You retain all ownership rights to the data you enter into OverSpend.me, including:

Subscription names, amounts, and billing cycles
Personal information (name, email, phone)
Preferences and settings

Data Protection

We protect your personal information using AES-256-GCM encryption for sensitive fields including email addresses, names, phone numbers, and subscription service names. See our Privacy Policy for complete details.

Account Deletion

You may delete your account at any time from Settings → Account → Delete Account. Account deletion is permanent and irreversible. All your data will be deleted immediately, with backup copies purged within 60 days.

6. Prohibited Uses

You agree not to use OverSpend.me to:

Violate any applicable laws, regulations, or third-party rights
Engage in fraudulent, deceptive, or misleading activities
Abuse, harass, threaten, or intimidate other users or our staff
Attempt to gain unauthorized access to our systems, other user accounts, or networks
Reverse engineer, decompile, or disassemble any part of the Service
Use automated scripts, bots, or scrapers to access the Service
Impersonate another person or entity
Upload viruses, malware, or other malicious code
Violate intellectual property rights of OverSpend.me or third parties
Use the Service for any commercial purpose without our express written consent

We reserve the right to suspend or terminate accounts that violate these prohibitions without notice or refund.

7. Third-Party Services

OverSpend.me integrates with the following third-party services to provide functionality:

AWS Cognito: OAuth authentication (Google, Facebook)
Stripe: Payment processing and billing
AWS SES: Email delivery for notifications
Twilio: WhatsApp notifications (optional, opt-in only)
Frankfurter API: Currency exchange rates (public API)
MongoDB Atlas: Database hosting with encryption at rest
Vercel: Application hosting and CDN

Third-Party Terms

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

Service Availability

We are not liable for any failures, interruptions, or issues caused by third-party service providers. We will make reasonable efforts to restore service but cannot guarantee uninterrupted access.

8. Intellectual Property Rights

OverSpend.me Intellectual Property

All content, features, and functionality of OverSpend.me are owned by OverSpend.me or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Limited Use License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use.

User Content Rights

You retain all rights to your subscription data and personal information. We do not claim ownership of your content.

9. Disclaimers and Limitation of Liability

Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO merchantability, fitness for a particular purpose, uninterrupted operation, accuracy, reliability, or freedom from viruses.

Not Financial Advice

OverSpend.me is a subscription tracking tool, not a financial advisor. We do not provide financial, investment, or tax advice. Analytics and insights are for informational purposes only. Consult a qualified financial professional for personalized advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERSPEND.ME SHALL NOT BE LIABLE FOR indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, or use, or business interruption.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR the amount you paid us in the 12 months preceding the claim.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, internet failures, or third-party service outages.

10. Indemnification

You agree to indemnify, defend, and hold harmless OverSpend.me, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights
Your violation of applicable laws or regulations
Any content you submit or actions you take through the Service

11. Termination

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, for violation of these Terms, illegal or fraudulent activity, abuse of the Service or other users, non-payment of Pro subscription fees, or any other reason we deem necessary to protect the Service or other users.

Termination by You

You may terminate your account at any time by navigating to Settings → Account → Delete Account or canceling your Pro subscription via the Billing Portal (if applicable).

Effect of Termination

Upon termination, your access to the Service will be immediately revoked, all your data will be deleted from active systems within 24 hours, backup copies will be purged within 60 days, and no refunds will be provided for unused subscription time.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by sending an email to your registered email address, updating the "Last Updated" date at the top of this page, and displaying a notice on the Service.

Material changes will take effect 30 days after notice is sent. Non-material changes (typo corrections, clarifications) take effect immediately.

13. Governing Law and Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@overspend.me and attempt to resolve the issue informally. We will respond within 30 days and work in good faith toward a resolution.

Arbitration

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except where prohibited by law.

14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OverSpend.me regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.
